Terms and Conditions
for Wandrith Motorcycle Journeys
Last Updated: 21 April 2025
By booking a motorcycle journey with us, you (“Hirer”, “you”, “your”) agree to these Terms and Conditions (“Terms”) which form part of the agreement between you and Wandrith Limited (“Wandrith”, “we”, “us”, “our”). Please ensure you read these Terms carefully before confirming any booking.
General Terms
- These Terms apply to all motorcycle journeys, rentals and related services provided by Wandrith. By booking a journey or rental, you confirm that you agree to be bound by these Terms. Where you are also booking a journey on behalf of any other person (“rider”) you are responsible for ensuring that every rider has agreed to be bound by these Terms.
Hirers and Riders
- All Hirers and riders of our motorcycles must:
- be at least 25 years old;
- have a minimum of two years’ experience riding motorcycles of similar size, capacity, and/or specifications to the one they are hiring;
- at all times while operating a Wandrith motorcycle carry on their person a physical original full and valid New Zealand motorcycle licence, international driving permit, or a valid overseas motorcycle licence or driving permit (any overseas documentation must be in English or accompanied by an official translation). Where any Hirer or rider holds an overseas based licence or an international driving permit, Wandrith shall have the sole discretion to determine whether to withhold its services for that Hirer or rider;
- have no criminal convictions for any offence involving a motor vehicle (including, but not limited to a conviction for driving while under the influence of alcohol or drugs); and
- must be in good physical and mental health to participate in our motorcycle journeys. We may request a health declaration before the start of a journey.
- By booking any services with Wandrith, every Hirer and rider warrants to us that they meet the requirements in clause 2.
- Even if any Hirer or rider meets all of the criteria in clause 2, we may (at our discretion) still withhold or withdraw our services if we believe on reasonable grounds that the services are not appropriate for any reason whatsoever.
Motorcycles
- All motorcycles provided by Wandrith:
- comply with New Zealand road safety requirements and have a certificate of fitness as required by the New Zealand Transport Agency; and
- are maintained by fully qualified motorcycle technicians.
- During the Hirer’s booking process, the Hirer will be entitled to specify their preferred motorcycle type. In the unlikely event the Hirer’s preferred motorcycle is unavailable, Wandrith will engage with the Hirer in good faith to reach a compromise acceptable to the parties.
- All Hirers and riders must at all times ensure that:
- Our motorcycles are not driven on a beach;
- Our motorcycles are not exposed to salt water;
- Our motorcycles are used in accordance with our reasonable instructions.
Nothing in this clause shall prevent our motorcycles from being driven on the Great Harbour Way in Wellington, New Zealand.
- If a Wandrith motorcycle requires recovery due to being ridden anywhere other than a legal road, the Hirer shall be solely responsible for all associated recovery costs.
Payment Terms
- At the time of booking, a 20% deposit is required to secure your booking.
- Final payment of the remainder of the booking and any charges for additional activities are due 60 days prior to your booking date.
- A refundable security bond of $2,500.00 is required 5 days prior to the pickup for all motorcycles. This bond will be refunded within 10 working days following the end of your journey or within 5 working days of any journey cancelled prior to commencement, provided the motorcycle is returned in the same condition as received. At our discretion, a failure to pay this security bond shall be deemed notice of cancellation by the Hirer.
Cancellations and Refunds Policy
- Cancellations by Wandrith: Wandrith reserves the right to cancel any journey at any time and for any reason. If cancellation occurs prior to the start of your journey, any payments made to us, including your deposit will be refunded in full and we will offer you the opportunity to re-book on a suitable alternative journey if available.
- Cancellations by Hirer: All cancellations must be received in writing. If you cancel your booking we will refund your payments in the following manner:
- For cancellations made 120 days or more before the journey start date, you will receive a full refund of the deposit less a $250 administration fee;
- For cancellations between 60 and 120 days before the journey start date, you will receive a 50% refund of the deposit less a $250 administration fee;
- For cancellations between 30 and 60 days before the journey start date, you will receive a 50% refund of all amounts paid (including the deposit) in relation to the booking, less a $250 administration fee;
- For cancellations made within 30 days before the journey start date, no amounts paid (including the deposit) in relation to this booking shall be refundable.
However, depending on the reason for the cancellation, where possible, and at our discretion, we may allow the Hirer the opportunity to defer or change the start date of a journey.
- In the event of a cancellation of a journey with us for any reason, we shall not be liable for any travel costs or expenses incurred by the Hirer or any other party in reaching the journey departure location. This includes, but is not limited to, airfare, accommodation, meals, and other incidental expenses. It is the responsibility of the Hirer and all riders to ensure they have appropriate travel insurance to cover such costs in the event of cancellation.
- We are not liable for any costs and not required to refund any charges as a result of a Hirer or rider cancelling or missing meals, activities or accommodation bookings once the journey has commenced for whatever reason (whether such delays are inside or outside of our control). It is the responsibility of the Hirer and all riders to ensure they have appropriate travel insurance to cover such events.
- Every Hirer and rider acknowledge that some journeys may include a reliance on transport provided by third parties and that such transport can be delayed or cancelled (such as the interisland ferry which is associated with a high level of cancellation risk based on weather conditions). Wandrith will under no circumstances be liable for such delays or cancellations – we strongly recommend that every Hirer and rider obtain travel insurance to appropriately cover delay and cancellation risks. However, in the event of such delays and cancellations, Wandrith will assist you in good faith and modify your journey to accommodate for the delays and cancellations (if reasonably possible).
Insurance
- Our motorcycles are fully insured. The standard excess for each insurance claim is as follows:
- $1,000.00 (plus GST, if any) for all Hirers/riders on a full New Zealand, Australia, or United Kingdom motorcycle licence;
- $1,500.00 (plus GST, if any) for all Hirers/riders on a full United States of America motorcycle licence;
- $2,000.00 (plus GST, if any) for all Hirers/riders on a full motorcycle licence from any other country.
This excess covers claims for motorbike damage, third party damages, and loss and theft of the motorbike or accessories.
- In the event any damage or loss is caused while you are in possession of our motorcycle and such damage or loss is covered under our insurance policies, you will be liable for payment of the insurance excess on all insurance claims and such insurance excess may be deducted from your security bond.
- You are liable for any damages and loss incurred that is not covered by our insurance policies (and such damages and loss may be deducted from your security bond). In this regard, you unconditionally and irrevocably indemnify us for all such damages and losses. Please note that insurance cover may be voided for the following (non-exhaustive) reasons:
- The Hirer or any rider breaching these terms;
- Damage caused by careless, wilful or reckless driving including whilst the Hirer is under the influence of alcohol or drugs;
- Damage caused by submersion of the motorcycle in water, such as river crossing, or exposure to salt water resulting from the Hirer’s negligence;
- The Hirer or rider’s licence being invalid, not current, or not appropriately rated for the motorcycle on hire; or
- The motorcycle was being operated in an unlawful manner, such as on the right-hand side of the road without good reason.
- In the event that you are involved in an accident whilst operating a Wandrith motorcycle, you must not admit fault or liability. Your insurance could be found null and void if you:
- admit responsibility for any loss or liability; or
- say or do anything that may prejudice our insurer's ability to defend, negotiate, or settle a claim made against you or Wandrith, or make recovery of the loss from any other person who may be responsible for it.
Repairs and Damage
- All Wandrith motorcycles are supplied with a puncture repair kit and roadside assistance.
- Where a Wandrith motorcycle suffers a puncture or minor damage, the Hirer or rider shall make the necessary repairs (if safe and possible to do so) and continue with caution to the next town where the tyre or damage should be checked and/or repaired. If it is not safe or possible to make the necessary repairs or to continue with caution, the Hirer or rider shall call the available roadside assistance line in the first instance, and if necessary, contact Wandrith for further instructions.
- In the event of a mechanical breakdown the Hirer or rider shall be required to call the available roadside assistance line in the first instance, and then contact Wandrith for further instructions. Wandrith shall act in good faith and undertake all reasonable endeavours to get a replacement motorcycle to the Hirer as soon as reasonably practicable and modify the journey to accommodate for any delays if possible.
- All repair costs that are not covered by insurance and relate to damage caused by the Hirer shall be at the Hirer’s cost and may be deducted from the Hirer’s security bond.
- Where the damage caused by a Hirer is so severe as to render the motorcycle unfit for use to complete the Hirer’s journey, Wandrith may, at its sole and absolute discretion, provide a replacement motorcycle. If no replacement is provided, the Hirer’s journey shall be deemed to be at an end and the Hirer shall not be entitled to any refund from Wandrith in relation to the same.
Fuel
- Wandrith motorcycles will be provided with a full tank of fuel on the commencement of a journey. Any further fuel required for the duration of a journey will be the responsibility of the Hirer.
- We will advise you of the type of fuel to use at the commencement of any journey. The Hirer must ensure that the correct type of fuel is used at all times. If you are ever in doubt about the type of fuel to use please contact us before filling up.
Fines and Infringements
- The Hirer is liable for all fines and infringements relating to the motorcycle for the period the Hirer is in possession of the motorcycle. This includes parking and speeding fines and such fines can be deducted from the security bond.
Damage and Default
- Wandrith reserves the right to terminate any journey and take possession of the motorcycle of any Hirer or rider who in our opinion is likely to endanger themselves or others or if the Hirer or a rider fails to comply with any of the terms of these Terms, or if the motorcycle is damaged. Replacement of a damaged motorcycle is at the discretion of Wandrith.
- Any towing associated with the repossession of a motorcycle by us will be payable by the Hirer and may be deducted from the security bond.
Governing Law
- These Terms and any booking with Wandrith are governed by the laws of New Zealand and any dispute will be subject to the exclusive jurisdiction of New Zealand courts.
Currency and GST
- Unless expressly stated otherwise, all monetary amounts stated in or payable under these Terms shall be in New Zealand dollars and exclusive of GST.
